Sweet Peaches Bedding "America's Next Sweetpeach" Giveaway OFFICIAL RULES

1. NO PURCHASE NECESSARY. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED BY LAW. ALL FEDERAL, STATE AND LOCAL LAWS AND REGULATIONS APPLY.
2. PARTICIPATION CONSTITUTES ACCEPTANCE OF RULES AND DECISIONS, CONSENT TO USE AND RELEASE OF CLAIMS. By entering this giveaway, each participant warrants that he or she has read and agrees to abide by all giveaway rules and that he or she is not prohibited from participating in the giveaway. Participation in this giveaway constitutes participant's full and unconditional acceptance of these Official Rules and the decisions of Sweet Peaches Bedding, its parents, affiliates, employees and agents, which are final, binding and non-negotiable in all respect. Each participant agrees to release, discharge, indemnify and hold harmless Sweet Peaches Bedding and its parents, affiliates, shareholders, employees, officers, directors, agents, representatives, advertising and promotion agencies and prize suppliers from any liability arising from or related to the giveaway, including without limitation, (a) unauthorized human intervention in the giveaway; (b) technical errors related to computers, servers, providers, or telephone or network lines; (c) printing errors; (d) lost, late, postage-due, misdirected, or undeliverable mail; (d) personal injury, death, and property damage; and (e) claims based on publicity rights, defamation, or invasion of privacy. Further, participants fully and unconditionally release all claims for consideration, copyright infringement and all other claims of any nature relating to the use of their entry, name or likeness.
3. ELIGIBILITY. This giveaway is open to anyone 13 years of age and older. Entrants under the age of 18 must have a parent's or legal guardian's permission to participate in this giveaway prior to entering. Proof of age must be furnished upon request. Employees, agents, independent dealers and affiliates of Sweet Peaches Bedding and its agents, affiliates and immediate family members of all such persons, are not eligible to participate in this giveaway. Sweet Peaches Bedding reserves the right, at its sole discretion, to cancel, terminate, suspend, or amend this giveaway at any time for any reason. Sweet Peaches Bedding further reserves the right to amend these giveaway rules at any time without prior notice, at its sole discretion. Sweet Peaches Bedding reserves the right to disqualify any participant for any reason, including, but not limited to, violation of these Official Rules or infringement of the rights of a third-party.
4. TO ENTER. This giveaway will run between September 22, 2009 and October 16, 2009. The giveaway will be posted on one (1) website: www.sweetpeachesbedding.com/contest. To enter this giveaway, participants are asked to complete the entry form posted on this website, including name and e-mail address by October 16, 2009 ("Eligible Entries") to be eligible to win this giveaway. Please only one contest submission per person and e-mail address. By submitting an entry, participants agree to abide by these Official Rules. Persons submitting entries under false pretenses will be disqualified. Sweet Peaches Bedding is not responsible for telecommunications, network, electronic, technical or computer failures of any kind. Sweet Peaches Bedding is not responsible for any lost or misdirected mail sent by participant or Sweet Peaches Bedding.
5. PRIZES. There will be two (2) winners randomly selected on October 19, 2009 from all Eligible Entries on October 16, 2009. Chances of winning will depend on the number of entries received. Each winner will receive a gift certificate to www.sweetpeachesbedding.com valued at $500. All decisions of the judges of this giveaway are final, binding and non-negotiable. No prize may be transferred or substituted.
6. IDENTIFICATION OF POTENTIAL WINNER. Sweet Peaches BEdding will notify the winners by email using the information provided on the entry form on or about XXX 2009. Upon receipt of an email confirmation by the winner(s), Sweet Peaches Bedding will email the winner(s) the gift certificate.
7. SPONSOR: This giveaway is sponsored by Sweet Peaches Bedding having an address of 2646 Fairway Ridge Drive, Mckinney, TX 75070. The prizes are provided by Sweet Peaches Bedding.
8. MISCELLANEOUS. By entering this giveaway, participants consent to Sweet Peaches Bedding's use of their first name for advertising and promotional purposes without additional compensation, except where prohibited by law. BECAUSE PERSONAL INFORMATION FROM PARTICIPANTS WILL BE COLLECTED BY ENTERING THIS GIVEAWAY, PARTICIPANTS SHOULD REVIEW Sweet Peaches Bedding's Privacy Policy, which can be found here. By entering this giveaway, participant authorizes Sweet Peaches Bedding to contact participant for commercial purposes via the e-mail address listed on the participant's entry form. There will be no use of participants name or other personal information for future commercial purposes except as in accordance with Sweet Peaches Bedding's privacy policy. This Agreement is governed by the laws of the State of Indiana, without giving effect to conflicts of law rules.
